The terms and conditions offered here constitute the agreement between you and Drive-2day. Booking a driving lesson and using the service indicates that you have unconditionally accepted the terms and conditions as they are listed in the agreement.
Definitions:
- Drive-2day, “we”, or “us" refers to the company/instructor providing the service. The terms including, but not limited to, "you", "your" or “yourself” can refer to any person, business or establishment making a booking with us.
Bookings:
- You are required to allocate enough time to allow you to arrive on time should you and your instructor decide to meet elsewhere. Drive-2day will not be held responsible for any cost incurred that has been caused by your inability to allocate enough time to reach your meeting-point on time.
- It is your responsibility to specify which transmission you require for your driving lessons. Should you fail to mention this before your first lesson, and a vehicle with the wrong transmission turns up, you will be charged for a full lesson of that specific transmission.
- Any bookings for driving lessons made via the website or any social media platforms are not confirmed, unless stated. Bookings are only confirmed once we get in touch with you confirming that your lessons have been added to the company diary. Without having received communication from us, an instructor will not turn up.
- You and your instructor are responsible for agreeing the timing, location and duration of individual lessons.
- If you wish to cancel a lesson, a minimum of 48 hours prior notice must be given. Any lessons cancelled with less than 48 hours’ notice, you will be charged in full for the lesson(s) concerned. Lessons must be cancelled directly with your instructor.
Prices & Payments:
- Drive-2day provides a quotation based on the information which has been provided by you. All prices, unless otherwise stated, are exclusive of VAT and if this charge is applicable, this will be charged in addition. If there are any material changes to the stated facts, we reserve the right to alter the provided quote.
- Our lessons contain a 15 minute waiting period after the agreed starting time. Any waiting period in excess of this time may result in you losing, or being required to pay for, any lessons booked in our diaries which are postponed or cancelled by you, especially if we are unable to obtain new replacement work for those appointment times. However, we reserve the right to postpone lessons if we consider the weather or road conditions to be unsuitable or dangerous. We cannot be held responsible for any costs incurred as a result of us having to postpone any lessons, for whatever reason.
- Payments for driving lessons can be made via cash or bank transfer.
- You are required to make payment for your driving lessons in advance of the training. At this point a binding agreement is made between yourself and us. This does not in any way affect your statutory rights to be provided with the services you have bought.
- The cost of tuition is based on the lesson price in force at the time of booking. You will be notified of any price changes a minimum of 7 days prior to the change coming into place.
- You cannot sell or transfer lessons which have been purchased in your name to any other person.
Legality:
- You must hold a current, valid driving licence (provisional or full), which must be produced on or in advance of your first driving lesson. You must prove your entitlement to drive and provide your driving instructor with a licence check code prior to your first driving lesson, alternatively your instructor will do this on the first lesson.
- You must also check and prove that you can read a number plate at a distance of 20.5 metres (i.e. 67 feet - about 5 car lengths), with prescribed visual aids (i.e. contact lenses or glasses) if normally worn. Please note if you need contact lenses or glasses to achieve this you must make sure you wear them on each and every driving lesson.
- Driving Lessons are only available to those who are aged 17 or over (or aged 16 and in receipt of the higher rate Disability Living Allowance - mobility component). You must hold a valid UK provisional licence and must be legally entitled to drive in the UK.
- You must inform your instructor of any matters which affect your ability or entitlement to have driving tuition, including loss of provisional licence.
- You must inform your instructor immediately if you receive any enforcement on your driving licence during the period you are taking driving lessons.
Lessons:
- Your instructor will carry the appropriate motor insurance, should you be involved in a collision as a learner driver while in control of driving the instructor’s tuition vehicle.
- All tuition will take place in the instructor’s vehicle, unless agreed otherwise.
- The instructor will make every effort to instruct the pupil to the highest standard, but can in no way be held liable for any errors that the pupil may make whilst driving and not accompanied by the instructor either before, during, or after a test.
- Any verbal or physical abuse against your instructor will not be tolerated and the instructor has the right to terminate the lesson immediately should this occur.
- The instructor reserves the right to terminate a lesson if he/she has reason to believe that the pupil is in any way under the influence of drink or drugs at the time of the lesson.
Tests:
- Practical Driving Tests will be booked by the student on the advice of their instructor. If a student wants to book their Practical Driving Test earlier than advised, they must arrange to take the test in another vehicle without their instructor present.
- The price paid for the driving test fee does not include the use of the car for the purpose of the test and any prior instruction. The current price per lesson will apply.
- The instructor reserves the right to withhold the use of his/her vehicle for a driving test.
- Driving tests can be booked by you or the instructor. Driving test bookings always take priority over other lessons. Therefore, your lesson may be postponed to allow for someone else's driving test and vice-versa. Changes to lesson bookings as a result of this will be notified immediately. Test appointments must be notified to us as soon as they are known to you, otherwise we cannot guarantee to provide a vehicle for the test or any lessons just prior to it.
- In the interests of customer and public safety we reserve the right to withhold the use of the training car for the test if, in our opinion, your driving is actually or potentially dangerous - behaviour which if repeated on the test would result in a test failure.
Liability:
Your instructor/Drive-2Day is not liable to you for any loss or damage caused where, and to the extent that:
- There is no breach of a legal duty owed to you by the relevant person or body;
- Such loss or damage is not a reasonably foreseeable result of such a breach of a legal duty;
- Any such loss or damage, or increase in the same, results from any breach or omission by you; or
- Any such loss or damage results from circumstances or matters outside of the reasonable control of the relevant person or body.
Your instructor/Drive-2Day shall not, in any event, be liable for losses relating to any business interests you may have including, without limitation, lost profits, loss of opportunity or business or business interruption.
Nothing in these Terms and Conditions will affect any statutory rights you may have as a consumer.
Complaints:
- This agreement will be undertaken in accordance with English law with yourself and Drive-2day agreeing to follow the exclusive jurisdiction of the courts with regards to any claim or dispute of matters connected with this agreement.
Changes to Terms and Records of Agreements:
- Drive-2Day reserve the right to change these terms and conditions at any time by posting changes on the website.
- It is your responsibility to review the website terms and conditions regularly to ensure that you are aware of the latest terms and conditions.
- Your use of this website after a change has been posted will be deemed to signify your acceptance of the modified terms and conditions.
- We recommend that you print off and retain for your records a copy of these terms and conditions from time to time and a copy of any terms and conditions relating to any product or service which you apply for on-line, together with any related application form completed and submitted.
